Fall River Man Who Raped and Intimidated Young Victim Sentenced to Two Decades In Prison
District Attorney Thomas M. Quinn III today announced that a Fall River man has been sentenced to serve 18 to 25 years in state prison after being convicted of raping, assaulting, intimidating and threatening a young family member on many occasions during a seven year time span.
Diocelito Dimas, 45, formerly of 81 Almy Street, pleaded guilty Tuesday afternoon in Fall River Superior Court to an 18-count indictment charging him with aggravated rape of a child, rape of a child with force, aggravated rape, indecent assault and battery on a person under 14, indecent assault and battery on a person older than 14, posing a child in the state of nudity, providing alcohol to a minor, witness intimidation, and assault and battery.
The “unagreed plea” was presented to Judge Renee Dupuis for consideration. The Commonwealth, led by Second Assistant District Attorney Silvia Rudman, argued for a 30-35 years state prison sentence, while the Mr. Dimas, through his attorney, requested a 10 to 15 years prison sentence.
After accepting his plea, Judge Dupuis sentenced Mr. Dimas to serve no less than 18 years and no more than 25 years in state prison. Judge Dupuis also placed Mr. Dimas on supervised probation for a term of 35 years. The conditions of probation include no contact with the victim(s); attend sex offender treatment at his own expense and remain in treatment until discharged by an approved sex offender therapist; no residing in a home with minors; no unsupervised contact with minors; no employment that puts him in contact with minors; no volunteer work that puts him in contact with minors; register as a sex offender; submit to the use of a GPS monitoring device during his probationary term; and the defendant must register every device used by him that is capable of accessing the internet with the probation department.
The defendant stood accused of raping a young family member on numerous occasions when she was between 10 and 17 years old, and of indecently assaulting one of the young family member’s friends on one occasion. The incidents mainly occurred in Fall River, although some occurred at other locations in Massachusetts. The defendant had threatened the young family member in order to assure her silence for nearly seven years.
To protect the victims’ identities, no further facts of the case can be released by this office.
“This was a tragic case of a sexual predator taking advantage of a young, unsuspecting family member and a friend of the victim. This defendant used threats and intimidation to make sure he was able to continue to repeatedly sexually assault the young victim for several years. This is a defendant who deserved the very harsh state prison sentence he received yesterday,” District Attorney Quinn said. “I want to applaud the main victim in this case, who appeared in court yesterday to present a victim impact statement. This young person’s courage, after suffering years of abuse, will be remembered by all of those who worked so tirelessly on this case. Assistant District Attorney Rudman, the Bristol County Children’s Advocacy Center and the Fall River Police Department performed a stellar investigation to make sure this defendant would be severely punished for his crimes.”
