Fall River Man Convicted of Brazen Shooting Sentenced To Up To Two Decades in Prison

A 24-year-old Fall River man who shot an unsuspecting victim on Quequechan Street in Fall River three years ago has been sentenced to serve 17 to 20 years in state prison after being convicted of a litany of felonies at trial, District Attorney Thomas M. Quinn III announced today.


Tiberias Albert was convicted by a jury of his peers of armed assault with intent to murder, Assault and Battery with a Dangerous Weapon, Carrying a Large Capacity Weapon, Illegal Possession of a Large Capacity Magazine, Carrying an Illegal Firearm and Carrying a Loaded Illegal Firearm. The jury convicted the defendant after a three-and-a-half week trial in Fall River Superior Court.


On Friday, Superior Court Judge Raymond Veary sentenced the defendant to serve 17 to 20 years in state prison. Assistant District Attorney Patrick Driscoll, who prosecuted the case along with Assistant District Attorney Michael Cahillane, argued for an 18 to 20 year prison sentence, while the defense requested a five year state prison term.


The shooting occurred on February 24, 2014 at around 5 pm. The victim, who did not know the defendant, arrived home to his apartment on Quequechan Street and found Mr. Albert sitting on his front porch.


The victim asked the defendant why he was sitting on his front porch, to which the defendant replied, “I am looking for a girl.” The victim told the defendant he did not know the female the defendant was looking for and suggested he check the home next door.


After a short period of time, while the victim was going through his mailbox, he saw the defendant a second time. The defendant approached him, said “fuck you,” and then fired two shots, striking the victim twice in the abdomen.  The 47-year-old male victim in this case did not know the defendant, nor did he do anything to provoke the defendant.


The victim was taken to Rhode Island Hospital for treatment of his injuries, where he remained for approximately one month.  While at Rhode Island Hospital, the victim was confined to the Intensive Care Unit and underwent numerous surgeries to repair his injuries.  After being released from RI Hospital the victim spent several months at a rehabilitation facility to help assist with his recovery.  


“But for the grace of God, the victim would have died from two gunshot wounds.  For no apparent reason, the defendant shot a 47 year old man.  The defendant has a history of convictions going back to age 14.  He has a prior conviction for possession of firearm and drug dealing,” said District Attorney Quinn.  “Despite his age, the defendant is a very dangerous person and needs to be kept off the street for a long time.  I would like to compliment the prosecutors for their perseverance in this case.”
